Affiliate Program Terms
Article 1 - Purpose
These terms (hereinafter referred to as the “Affiliate Terms”) define the conditions of the affiliate program offered by Parkshare (hereinafter referred to as the “Program”), operated by Parkshare, owner of the “Parkshare” trademark (hereinafter referred to as the “Publisher”).
The Program allows any user registered on the Parkshare platform to recommend the service to parking administrators and receive compensation when the conditions set out herein are fulfilled.
Joining the Program implies full acceptance of these Affiliate Terms, as well as the Terms and Conditions of the Parkshare platform.
Article 2 - Eligibility
Any user with an active account on the Parkshare platform may join the Affiliate Program, with no minimum activity or volume requirements.
Registration is completed through the “Affiliate Program” section in the account settings. By clicking the “Join the program” button, the user accepts these Affiliate Terms and becomes an “Affiliate”.
A unique affiliate code in the format A_XXXXXXXX (where X is an uppercase letter or a digit) is generated once upon registration and cannot be modified afterward.
Article 3 - Program Operation
The Affiliate shares their code with a parking administrator (hereinafter referred to as the “Referral”). The Referral enters this code in their parking dashboard, in the subscription section, before subscribing to their first paid plan.
A Referral using a valid affiliate code receives one (1) free month on their first paid subscription, according to the conditions defined by the platform at the time of subscription.
An affiliation is permanently recorded as soon as the code is accepted by the platform. The code can no longer be entered or modified once a paid subscription has been activated for the relevant parking facility.
An Affiliate may not use their own affiliate code for a parking facility they administer. Any attempt at direct or indirect self-referral is automatically rejected by the platform.
Article 4 - Conditions for Compensation Eligibility
Affiliate compensation is triggered under the following conditions depending on the type of subscription chosen by the Referral:
- Monthly subscription: compensation is triggered after four (4) consecutive monthly payments made by the Referral on the same subscription.
- Annual subscription: compensation is triggered after the first annual payment made by the Referral.
In addition, to qualify, an affiliation requires that the Referral’s parking facility has maintained a minimum of 20 parking spaces continuously throughout the entire period from the first paid subscription to the triggering of compensation. Any reduction in the number of spaces below this threshold during this period suspends the right to compensation for the affiliation concerned.
If the Referral’s subscription is cancelled before the above conditions are met, no compensation shall be owed to the Affiliate.
The Publisher shall not be held responsible for the cancellation of the Referral’s subscription, regardless of the reason.
Article 5 - Compensation Amount
The compensation amount is set at €50.00 (fifty euros) per qualified affiliation, meaning per parking facility meeting the conditions described in Article 4.
Each affiliated parking facility meeting the conditions set out in Article 4 entitles the Affiliate to separate compensation.
A single Affiliate may receive multiple compensations corresponding to multiple affiliated parking facilities, up to a total limit of €600.00 (six hundred euros) per calendar year.
This amount is determined by the Publisher and may be modified at any time for future affiliations. Affiliations already registered before any modification shall retain the amount applicable at the time of their registration.
Compensation is expressed in euros and cannot be exchanged or converted into any other form of value.
Article 6 - Payment Terms
Once an affiliation qualifies under Article 4, the Publisher informs the Affiliate by notification and/or email.
The Affiliate is then invited to provide their bank details (IBAN) in order to receive the corresponding bank transfer.
Payment shall be made within a maximum period of thirty (30) days following receipt of the Affiliate’s complete bank details and validation by the Publisher.
The Publisher reserves the right to suspend or refuse payment in the event of doubts regarding the legitimacy of an affiliation or in case of breach of these Terms.
The following are notably considered fraudulent, without this list being exhaustive:
- the creation of fake accounts or fake parking facilities;
- direct or indirect self-referral;
- the transmission of false or misleading information;
- the artificial creation of subscriptions solely intended to generate compensation;
- any abusive use of the Program contrary to its intended purpose.
Article 7 - Affiliate Obligations
The Affiliate agrees to promote Parkshare in a fair, transparent and lawful manner, compliant with applicable regulations.
The following practices are strictly prohibited:
- sending unsolicited messages (spam);
- misleading or deceptive commercial practices;
- impersonating Parkshare or the Publisher;
- any communication likely to damage the image or reputation of Parkshare.
Any breach may result in the immediate suspension or exclusion from the Affiliate Program, without notice or compensation.
Article 8 - Affiliate Tax Obligations
Compensation received under the Program constitutes taxable income.
It is the Affiliate’s responsibility to declare such compensation to the relevant tax authorities in accordance with the legislation applicable in their country of residence.
The Publisher shall not be held responsible for any omission or error in tax declarations made by the Affiliate.
Article 9 - Modification and Termination of the Program
The Publisher reserves the right to modify, suspend or terminate the Affiliate Program at any time, with reasonable notice communicated to Affiliates by email or in-app notification.
In the event of termination of the Program, affiliations already qualified under Article 4 shall give rise to payment of the corresponding compensation.
Affiliations still in the qualification process and not yet meeting the triggering conditions shall not entitle the Affiliate to any compensation.
The Publisher may also exclude an Affiliate from the Program in the event of breach of these Terms, proven fraud, or violation of the platform’s Terms and Conditions.
Article 10 - Personal Data
As part of the Program, the Publisher processes Affiliates’ personal data (including bank details provided for payment purposes) in accordance with its Privacy Policy .
The Affiliate’s bank details are used exclusively for compensation payments and are not retained beyond the period necessary to process such payments.
Article 11 - Applicable Law and Jurisdiction
These Affiliate Terms are governed by French law.
Any dispute relating to the interpretation or execution of these Terms shall fall under the jurisdiction of the French courts, subject to any applicable legal provisions.
